Welcome to our online store, the www.oceanandstreamstore.com (“Site”). The following terms and conditions govern the use and sale of products from the Site. Please make sure that you have read and understood these terms and conditions before you use our website. By making a purchase from this website, you have agreed to these terms of use.

The products purchased on the Site are sold directly by OCEAN AND TRADE SRLs (“OCEAN AND TRADE”), which has a registered office in Italy at Giovanni Calandriello 1, 82100, Benevento (Bn) with business register number and VAT number 01619810623.

 

Contract and Order

To place an order for the purchase of one or more products on the Site, you must fill out the online order form and submit it electronically to OCEAN AND TRADE. An order shall be deemed submitted when OCEAN AND TRADE receives your order form electronically, and the order information has been verified as correct. This form acts as a contract between you and OCEAN AND TRADE.

Once we have received your order we will send a confirmation to your e-mail address. It is therefore important that you enter the correct e-mail address when placing your order, also in order to facilitate any contact with customer service you may have in the future. The purchase order receipt sent via e-mail will contain a summary of the information related to the order form.

All products remain in OCEAN AND TRADE property until full payment is executed. If the order form has been sent and the price has been paid for items that are no longer available, the amount paid for those items will be returned to you. If the price is obviously incorrect, this may allow OCEAN AND TRADE to cancel the purchase and return the amount paid in the best way. Prices are subject to change and will be as quoted on our website from time to time, except in cases of obvious error.

You have the right to cancel your contract with OCEAN AND TRADE in relation to products purchased from the Site, without  penalty and for any reason, by notifying OCEAN AND TRADE in writing via e-mail within fourteen (14) calendar days, beginning on the day you receive the products. In this case you will receive a full refund of the price of the products including standard delivery costs, if any have been paid (but excluding supplementary costs for expedited delivery options, if any). Service, Product Price and Information

On the Site, we offer high-quality products, with the descriptions shown on each product page.

The Site may contain information not accurate, complete, or current that may relate to product descriptions, pricing, and availability. We reserve the right to correct, modify, or update information at any time without prior notice. This can happen during and after your order submission. If you are not satisfied with your purchase you may return it, as stated in our Return Policy.

The product images should be seen as illustrations only, and do not guarantee correct appearances and characteristics of the product, in terms of resolution and colors due to the Internet browser or monitor used from your side.

This site may contain certain historical and geographical information, only as general reference.

We reserve the right to modify or discontinue our service (or any part or content thereof) without notice at any time. We shall not be liable to you or to any third party for any modification, price change, suspension, or discontinuance of the service.

You agreed that it is your responsibility to monitor changes to our site. Any reliance on the material on this site is your own responsibility.

 

Payments

All products remain in OCEAN AND TRADE property until full payment is made. Payment of the product prices and related costs for shipping and delivery must be made by using one of the procedures indicated on the order form.

PayPal & Credit/Debit Card

If you choose to pay your order via Paypal, you will be forwarded to Paypal and asked to log in your account or register yourself. Once you complete the payment via  the selected payment method (Paypal balance, debit or credit card), Paypal will send us a confirmation. After that we will ship your goods as soon as possible. If you do not have a PayPal account, you can enter your debit or credit card information during checkout to complete the payment. Wire Transfer (only for Italian customers)

The wire transfer payment option is only available for Italian customers. After you have placed your order, you will automatically receive a confirmation email. There you will find our account information and the required amount to pay. Please note your order number as payment reference so we can connect your payment to your order as quickly as possible. By choosing the wire transfer payment option, you agree to pay immediately after the order has been placed. Affirmation of the contract and delivery are effective upon receipt of payment. OCEAN AND TRADE is entitled to cancel an order if payment is not made within 5 working days from the time the order was placed. Once your payment is received, we will send the goods as soon as possible.

Cash on Delivery (only for Italian customers)

Cash on Delivery (COD) is available as a payment method only for Italian customers and for order value not exceeding 400 euro (€). You can pay for COD order by cash at your location, detailed as shipping address in the order form.

The amount on your invoice must be paid in full with cash to the driver or courier upon receipt of the goods. If the driver or courier attempts to collect a different amount other than what is stated on your invoice, please contact us before payment.

A maximum of 1 COD order per customer within 5 working days is allowed when the orders have not been delivered or the cash on delivery amount has yet to be collected. COD refunds for returned items can only be made to a bank account. Payment by COD incurs a non-refundable fee of 5 euro (€).

 

Shipping and Delivery

OCEAN AND TRADE delivers worldwide. Deliveries are made in cooperation with the postal services and their partners in countries around the world. Our goal is to deliver orders as quickly as possible. Your package will arrive within 4-6 working days to the address you provided. The estimated delivery time shall be used only as an approximated reference and can vary across countries.

The shipping charge are determined at the time of checkout and mainly based on your ship-to country. Please locate your country below for details.

If you enter an incorrect address when ordering, OCEAN AND STREAM is not responsible for the delivery time that might be longer than normal. The customer is fully responsible for entering the correct information when ordering. We recommend you to check the details before placing an order.

In cases wherein you as a customer believe that the delivery is delayed in such a way that you no longer wish to fulfill the order, it is your responsibility to cancel the order. In cases where the order has been delivered, the customer is required to receive the order. Cancellation is not valid until the customer has confirmed with us by e-mail.

During shopping on the Site, we will collect some of your data to fulfill your purchase. You have the right to request access to your data and if there is anything wrong, you can have it changed or removed. Responsibility

OCEAN AND TRADE shall be exempted from liability for damages and other penalties on the performance of the contract prevented, hindered, or delayed by circumstances beyond our control. The release factors to be considered include government intervention, new or amended legislation, lack of state, war, fire, flood, labor disturbance, prohibitions, restrictions, sabotage, poor transport or weather conditions, delay of delivery from suppliers, and if the company is exposed to criminal activity that affects activities.

Governing law

These terms and your use of the Site are governed by Italian law. To the extent permitted by law, Italian courts shall have exclusive jurisdiction over any dispute arising from these terms of use and your use of the Site. Any dispute between the parties relating to this contract shall be brought before the Court of Benevento (Italy).

 

IP rights

All intellectual property rights on the Site and in the content published on it are owned by OCEAN AND TRADE or its subsidiaries and licensors. Without declared permission of OCEAN AND TRADE, any external use of the Site or its content is prohibited.

The Site may include user-generated content from social media applications, such as images, photos, videos and the likes, OCEAN AND TRADE does not claim any ownership in the rights, and will take no legal responsibility for it.

 

Warranty

After purchase of a product, you will also receive a two-year limited warranty from OCEAN AND TRADE. This warranty only covers manufacturing defects on the product itself (movement, case, crystal, glass, wood parts).

To request repair or replacement of the product covered under the warranty, please contact us by sending an e-mail to our Customer Care, available from the “Contacts” section of the Site. Your e-mail request shall include details of order number, first name, last name, e-mail address of account used for the order, shipping address and a detailed description of the issue. Please write “Restore under warranty” as the subject of your e-mail request.

Please note that repair or replacements will be charged in the following cases, even during the warranty term:

  • Superficial changes that occur during normal wear and aging. For example, minor scratches on the case/crystal, variation of the color on the wristband, chrome plating removal, and similar cases.
  • Damage caused by your modification.
  • Damage caused by improper use (crushing, knocks, dents and the like).
  • If the product is not more under warranty.

Please note that battery replacement will be charged even during the warranty term.

This warranty guarantees that you can receive free replacement of the product in accordance with the terms set and within the specified term, and shall not restrict any of your lawful right.

You nevertheless have the right to object, in part or in full:

Return Policy

Your satisfaction is important for Us. If, for any reason whatsoever, you are not satisfied with your order, you may exercise your right to cancel your purchase and return purchased products. You must inform OCEAN AND TRADE of your decision to cancel, by contacting us.

It is important that you as a customer carefully check your goods / products when you receive your shipment in order to verify that the products are the correct items you purchased and not damaged. If your product is damaged in transport, whether the damage is visible or hidden, you must report it as soon as possible to the carrier. If you receive your item and see that it is damaged or does not match the one you ordered, you shall also contact us.

For exchanges and returns, you will be responsible for the return shipping cost but OCEAN AND TRADE will pay for shipping the exchanged item(s) back to you, after we received and processed the item(s) you are returning.

Defective products returned to OCEAN AND TRADE should be treated as if they are faultless. In all types of returns it is extremely important that the product is packaged in such a way that it cannot be damaged during transit. OCEAN AND TRADE has the right to replace defective goods with goods of the same model. If the item has been discontinued, the customer will receive a full refund.

 

Conditions for return

According to our policy, if you want to cancel the purchase of your product and obtain a refund, and in order for you to assist us in processing your request as quickly as possible, we will ask you the following:

  1. Within fourteen (14) calendar days of the date you received your purchased product (or for purchases of multiple products, the date on which you received the last product), please contact us by sending an e-mail to our Customer Care, available from the “Contacts” section of the Site. Your request for return shall include details of the items that you want delete from your contract of sale with us: order date, date received, order number, e-mail address of account used for the order, plus your first name and last name. Please write “Return request” as the subject of your e-mail request. After this, we will get back to you shortly with instructions on how to return the item(s).
  2. The products must be returned unwashed, not worn, undamaged, tags attached, complete and unused, in their original packaging (including its original seal).
  3. The products must be shipped back within fourteen (14) calendar days starting on the date you notify us of your decision to cancel.

Whatever form of payment used, OCEAN AND TRADE will give you a refund for such cancelled purchase, including standard delivery costs, if any have been paid (but excluding supplementary costs for expedited delivery options or other additional expenses), within fourteen (14) calendar days of the day we receive the returned products.

Should you decide to exercise your right to return purchased products, please take reasonable care of the products. OCEAN AND TRADE has the right to reject returned products and/or make a claim against you, for example, in cases wherein the products are returned without the corresponding tag or seal or that have been altered from their original status, worn, used or damaged. You will be notified if the returned products cannot be accepted. In this case, you may choose to have the products delivered back to you at no expense by OCEAN AND TRADE. If you refuse the option above, OCEAN AND TRADE reserves the right to retain the products and the amount paid for your purchase of the products.

The cancellation set right out above does not apply to: (a) sealed products which are unsealed following delivery, wherein return of such products is unsuitable due to health protection or hygienic purposes; (b) products which are adjustedto your specifications or clearly personalized; or (c) products which have become inseparably mixed with other items after delivery.

 

Refund process and time

After OCEAN AND TRADE has received the returned products and checked that the products meet all requirements, you will receive an e-mail that the returned products have been accepted. Whatever form of payment you used (credit/debit card, PayPal, cash on delivery), the refund procedure will start within fourteen (14) calendar days of the day we receive the returned products. You may be liable for, and we may deduct from any refund due to you, any diminution to the value of the returned products caused by your handling of the products, save to the extent necessary to ascertain the characteristics, functions or nature of the products.

The time period for refunding the amount you paid for purchasing the returned products depends on the form of payment used:

  • Payment by PayPal: refunds will be credited to your PayPal account. The actual reimbursement to the credit card associated with your PayPal account depends on the company that issued the card;
  • Payment made by Bank transfer or Cash on delivery: refunds will be credited to your bank account, that you indicate within the return e-mail request; the time needed for refunding depends on the information you provided in your order; normally refunds take place within a month, depending on the bank’s own policies. Please remember that it is necessary to have a bank account in order to receive a refund for bank transfer or cash on delivery orders.

 

Conditions for item exchange

Based on the requirements detailed below, you shall be entitled to exchange your product for a different size or color of the same model. Exchanges are subject to product availability at our warehouse. You can request an exchange by sending an e-mail to our Customer Care,  available from the “Contacts” section of the site.

The request for an exchange of the product is subject to the following conditions:

  1. You may only request the replacement of one or more purchased products with products of the same model, but in a different size and/or color. The available replacement options shall be verified and confirmed by us;
  2. You may request to exchange one or more purchased products within and not later than fourteen (14) calendar days starting on the day you receive the products, by sending an e-mail to our Customer Care,  available from the “Contacts” section of the site. Your request for exchange shall include details of the items received that you want to replace, and size or color of the same model you require for exchange. In addition, in order to assist us in processing your request, please provide  details of order date, date received, order number, e-mail address of account used for the order, plus your first name and last name;
  3. The products to be replaced should be returned within fourteen (14) calendar days of the day you received an e-mail from us confirming the availability of requested different size and/or color;
  4. You may only submit a single replacement request for each product purchased;
  5. The products for which you request the replacement must be returned to OCEAN AND TRADE in their original packaging. They must not have been used, worn, washed, modified or damaged, and they must still have their identification tag attached with the disposable seal;
  6. The products to be exchanged that are part of a single order must be returned to OCEAN AND TRADE in a single shipment. OCEAN AND TRADE reserves the right to refuse products of the same order that are shipped for replacement in different stages.

After receiving the products to be exchanged, OCEAN AND TRADE will inspect the products to check that all the above requirements have been fulfilled. OCEAN AND TRADE will then verify the actual availability of the replacement products in its warehouses  to ensure that the size and/or color you have selected in exchange are available.

If the selected replacement products are not available in the warehouse, OCEAN AND TRADE will not be able to accept your request for an exchange and will give you a refund of the original price of the products originally purchased in accordance with the procedures specified in our Return Policy (please refer to Conditions for return and Refund process and time).

If the selected products are available in the warehouse, OCEAN AND TRADE will accept your request for an exchange and will send you an e-mail confirming the shipment of the replacement products. Shipment will occur within thirty (30) working days and the costs for shipping the replacement products shall be borne by OCEAN AND TRADE.

You will be contacted by OCEAN AND TRADE if your request for an exchange cannot be accepted because the above conditions have not been met. In this instance, you can have the original products shipped back to you at your expense or OCEAN AND TRADE will issue a refund in accordance with the procedures set out into Return Policy (please refer to Conditions for return and Refund process and time).

The exchange products are subject to a subsequent product return procedure, in accordance to Return Policy (please refer to Conditions for return and Refund process and time).

 

Disposable Seal

All products sold by OCEAN AND TRADE include an identification tag, complete with a disposable seal. Please try on the products without removing the tag and seal. Returned products without the tag or seal will not be accepted.
